PDF Library respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have adopted the following policy regarding copyright infringement. This policy is designed to provide a clear process for copyright owners to report alleged infringements and for users to respond to such claims.
1. Copyright Policy
We respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. It is our policy to: (a) Block or remove access to material that we believe in good faith infringes the copyright of a third party; (b) Terminate the accounts of users who are repeat infringers in appropriate circumstances; (c) Accommodate standard technical measures used by copyright owners to identify and protect their works. If you believe in good faith that any content or material available through our Service infringes your copyright, you may submit a written notification of claimed infringement as described in Section 2 below. Please note that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that content is infringing.
2. Filing a DMCA Notice
If you are a copyright owner or an agent thereof and believe that any content on our Service infringes your copyrights, you may submit a written DMCA notice to our Designated Copyright Agent containing the following information: (a) A physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) Identification of the copyrighted work(s) claimed to have been infringed; (c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to locate the material (e.g., the URL of the document page); (d) Your contact information, including your name, address, telephone number, and email address; (e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; (f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner. Please send the completed notice to our Designated Copyright Agent using the contact information in Section 5 below. Failure to include all required information may result in a delay in processing your request.
3. Counter-Notification Procedure
If you believe that material you posted on the Service was removed or access to it was disabled as a result of a mistaken or misidentified DMCA notice, you may file a counter-notification. To be effective, a counter-notification must be a written communication addressed to our Designated Copyright Agent that includes substantially the following: (a) Your physical or electronic signature; (b) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled; (c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; (d) Your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the federal court in your judicial district (or the federal court located in our jurisdiction if you are outside the United States) and that you will accept service of process from the person who provided the original DMCA notice or their agent. Upon receipt of a valid counter-notification, we will forward it to the original complainant and inform them that the removed material may be restored in 10-14 business days unless the complainant files a court action seeking to prevent the restoration.
4. Repeat Infringer Policy
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright or other intellectual property rights. A 'repeat infringer' is a user who has been the subject of more than one valid DMCA notice regarding material they have posted or uploaded to the Service. We also reserve the right, in our sole discretion, to terminate or disable the accounts of users who engage in flagrant or egregious infringement even for a first offense. We keep a record of all DMCA notices and counter-notifications and cooperate with copyright owners and law enforcement agencies in identifying and taking action against repeat infringers.
5. Designated Copyright Agent
All DMCA notices and counter-notifications should be submitted to our Designated Copyright Agent. Please use the contact information below for all DMCA-related correspondence: Email: dmca@pdflibrary.example.com. Alternatively, you may submit your notice through our contact page. We recommend that you consult with legal counsel before filing a DMCA notice or counter-notification to ensure your rights are properly protected. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
